The term ‘OJEU’ stands for the Official Journal of the European Union. The OJEU is the main source of European public procurement law and contains all EU primary and secondary legislation relating to public contracts.

The Public Contracts Regulations 2015 (the ‘Regulations’) implement Directive 2014/24/EU on public procurement in the UK, and came into force on 26 February 2015. The Regulations sets out the legal framework for procuring goods, services and works by contracting authorities in the UK.

Under the Regulations, a contracting authority must publish a contract notice in the OJEU where the value of the contract exceeds certain financial thresholds set by EU law. These are:

– £172,514 (€221,000) for services contracts;

– £4,348,540 (€5,548,000) for supplies contracts; and

– £4,348,540 (€5,548,000) for works contracts.

Where the value of a contract does not exceed these thresholds but would do so if it were to be aggregated with one or more other contracts within a 12 month period, then those other contracts must also be advertised in the OJEU.
