Unintentional tort: A type of unintentional conduct that results in both physical and nonphysical harm to another person or entity. Unintentional torts arise when a person’s conduct does not amount to a breach of contract, but instead causes injury or damages in some other way. Examples include negligent driving, causing a slip and fall accident, or releasing hazardous substances into the environment without permission. Regardless of intent, the courts will generally hold liable any persons responsible for causing harm through an unintentional tort.
