Due Process Definition

The Due Process Clause is a constitutional guarantee that all individuals will receive a fair and just legal process. This includes the right to a fair trial, with adequate notice and opportunity to be heard. It also includes the right to an attorney, and the right to confront one’s accusers. The Due Process Clause applies to both criminal and civil proceedings.
