Esign Act Requirements

The Electronic Signatures in Global and National Commerce Act (ESIGN) was created with the intention of promoting and protecting the capabilities of electronic records and signatures. This legislation provides uniform standards on how they be used, accepted and enforced. It allows companies to have access to secured business documents over the internet that are legally binding.

ESIGN’s requirements are relatively straight forward: All electronic documents must be formatted in a way that allows parties to verify its content, sign it, store it, and transmit it securely. Additionally, an electronic signature must reflect the name or mark of the signer and evidence must be kept to prove each document’s origin and all associated activities. By complying with these requirements, businesses can have peace of mind knowing that their legal processes are secure and compliant.
