A last will and testament is a formal legal document that outlines how an individual’s assets and property should be dispersed upon their death. It also contains any special instructions regarding the care of minor children or individuals with disabilities who may need additional care. A validly executed Last Will and Testament is recognized as evidence to settle an estate, meaning all provisions in the will are followed by executors, trustees and other court officers. Although no particular format is required for creating a will, there are certain accepted standards and protocols which must be included to ensure the document is valid and binding. These include declaring individual’s identity, providing detailed instructions on how to distribute assets, confirming the legal status of the document, and having two witnesses sign the will.
