Procedural Law Definition

Procedural law is the body of law that sets forth the process for adjudication of legal disputes. This includes both criminal and civil procedure. It is sometimes also referred to as due process or as the rules of court.

The Constitution guarantees certain procedural rights to all citizens, including the right to a speedy and public trial by jury, the right to counsel, and the right not to be subjected to double jeopardy. Procedural law also includes rules governing the admissibility of evidence, plea bargaining, and sentencing.
