Tenancy at Sufferance – A tenancy at sufferance occurs when a tenant who has been wrongfully occupying the property remains on it after being notified of their illegitimacy. This type of tenancy often occurs if a previous tenant remains in the premises after their lease agreement has expired, or when a tenant is asked to leave but does not do so. In this circumstance, the tenant holds what is known as a ‘tenancy at sufferance’, whereby they remain in possession of the property without permission from the owner or landlord. As such, the owner or landlord may have the right to evict the tenant without going through the normal legal eviction process.
